Terms & Conditions

TERMS & CONDITIONS

*PAYMENT TERMS:

i.    Full payment of the contract amount is due 48hrs prior to the booked date of any funeral services.

ii.   The Applicant is solely liable for full payment of the contract amount, or any shortfall amount arising from incomplete payment by a third party.

iii.  Goods and Services included in the schedule of the Funeral Contract, but not included in the ‘TOTAL (Full Price)’ or ‘DISCOUNTED TOTAL’ will be invoiced separately.  PAYMENT TERMS – Strictly 7 days from date of invoice.

1.  * In the event that the Applicant fails to adhere to the agreed-upon payment terms as specified above, the following actions may be taken by Perth Cremations without limitation or further notice:

i.    Postponement of Services: Perth Cremations reserves the right to suspend or delay the provision of services, including any scheduled dates (and/or times) specified in the Contract, until full payment has been received,

ii.   Cancellation of Contract: Perth Cremations may, at its discretion, cancel the Contract in its entirety, with no further obligation to provide any services. In such a case, the Client shall remain liable for any outstanding amounts due up to the point of cancellation, and no refund will be issued for any previous payments made.

iii.  Amendment of Contract to ‘Basic Services Only’: Perth Cremations may unilaterally amend this Contract to provide only the most basic, minimum services required by the Applicant, as determined by Perth Cremations, without affecting the Applicant’s obligation to pay the full cost for those basic services.

2.   The Applicant agrees to indemnify, defend, and hold harmless Perth Cremations, its employees, agents, and affiliates from and against any and all claims, actions, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with any financial or personal hardship experienced by the Applicant, as a result of any actions taken by Perth Cremations (1. i-iii above), due to non-compliance with the payment terms of this Contract. The Applicant acknowledges that any such hardship is the result of their own failure to comply with the payment terms and waives any legal recourse for such claims.

3.   By signing this Contract, the Applicant agrees to be bound by the terms outlined above and acknowledges the potential consequences of non-compliance with payment obligations.

4.  * The ‘DISCOUNTED TOTAL’ amount entered on the Funeral Contract, applies when full payment of that amount is received within 3 calendar days from the date the contract was signed by both parties. The amount payable reverts to the ‘TOTAL (Full Price)’ if payment was not completed within the applicable time-frame.

5.   Perth Cremations gives consent to the applicant, that enables changes to be made to the goods and services described, and itemised in the SCHEDULE of the Funeral Contract, including deletions, additions and substitutions, so long as the change(s) can be completed in time for the ‘service’. In the event of any services or goods being provided/completed, prior to being notified of change(s), the client will be required to pay for the associated costs incurred, such as:
Body Transfer – $275 during business hours; $495 after hours.
Body Holding Costs – $16.50 per day.
Body Preparation costs (mortician services, embalming etc) – $ as per mortician’s invoice.
Floral arrangements (using fresh flowers and leaf) – $440
Permits, certificates, Doctor’s fees, etc – $ as per providers’ invoice.
Coffin (only if personalised and/or body already encoffined) – $ as per cost of selected coffin.

* We understand that payments toward funeral costs can come from numerous and varied sources. Please discuss your arrangements for payment with our funeral staff so they can ensure you have the appropriate documents required by different institutions, to release funeral funds.

Examples of circumstances where exemptions may apply include, (but not limited to):
i.    Payment with funds from deceased’s bank account.
ii.   Payment with funds from Funeral Insurance or, Funeral Bond or, Member’s Funeral Fund.
iii.  Consecutive public holidays preventing access to funds held with financial institutions.
iv.  Payments/Contributions from eligible Trusts.
